Resumen
La Propiedad Intelectual protege los derechos que corresponden a los autores respecto a las creaciones originales o novedosas fruto de su intelecto. Comprende dos ramas principales: el Derecho de Autor y la Propiedad Industrial. La presente investigación se centra en las valoraciones que se realizan a bienes intangibles, objeto de protección por la Propiedad Industrial que constituyen aportaciones al capital social de las Sociedades Anónimas en las que interviene capital extranjero. En las Sociedades Mercantiles, para conformar su patrimonio, se permite la aportación de dinero o de bienes (los no dinerarios), estos últimos bajo la condición de ser susceptibles de valoración económica; los intangibles clasifican como aportaciones no dinerarias y sobre su mecanismo de valoración resulta bastante complejo, por lo que el objetivo general de esta investigación radica en: determinar cómo se deben realizar las valoraciones económicas de las aportaciones de bienes intangibles en las Sociedades Anónimas en Cuba para los inversionistas nacionales. Para darle cumplimiento a dicho objetivo se realizó una sistematización de la legislación vigente en el país que regula esta materia y a partir de ello llegamos a la conclusión de que en el ordenamiento jurídico cubano no existe una legislación que regule la forma de realizar las valoraciones económicas de las aportaciones que consisten en bienes intangibles de Propiedad Industrial en las Sociedades Anónimas en Cuba para el caso del inversionista nacional.
Abstract
The intellectual property protects the rights that correspond to the authors to the original or novel creations fruit of their intellect. It comprises two main branches: Copyright and Industrial Property. The present investigation focuses on the valuations that show intangible assets, object of protection for property Industrial property that contribute contributions in social capital of the Public Limited Companies in which foreign capital intervenes. In the Mercantile Societies, in order to comply with their patrimony, information can be obtained about the benefits of the economic goods. The intangibles classify as non-monetary contributions and on the mechanism of valuation, the results, the complexes, the general objectives of this research, the radio, and the results of the intangible assets in the Corporations in Cuba for the national investors. In order to comply with this objective, a systematization of the legislation in force in the country that regulates this matter was carried out, and from this we come to the conclusion that in the Cuban legal system there is no legislation that regulates the way of making the economic valuations of the contributions that consist of intangible assets of Industrial Property in the Corporations in Cuba in the case of the national investor.
