Resumen
Las transformaciones sociales y culturales operadas en nuestra sociedad han provocado un cambio en el status social del niño; en el ámbito jurídico este hecho tiene reflejo en el interés por dotar al menor de un adecuado marco de protección de sus derechos, re-enfocando la construcción del edificio de los derechos humanos de la infancia, confiriendo al menor un creciente protagonismo socio jurídico reconociéndole como sujeto pleno de derechos. Esta modificación supone una transformación del enfoque tradicional proteccionista, donde al menor se le asigna un papel pasivo de cuidados y atenciones de los adultos, para pasar a ser concebido como sujeto activo llamado a participar en las decisiones que forman y conforman su personalidad.
Abstract
The social and cultural changes that have taken place in our society, have transformed child’s social status; in legal terms, these changes have raised an interest in endowing the minor with a suitable protection frame- work for their rights, as well as they has refocused the structure of childhood human rights by granting underage citizens an increasingly social and legal leading role as full right subjects. This transfiguration entails a turnabout in the traditional protectionist approach, in which the child used to play just a passive role, object of adults’ care and attention, and they have begun to be conceived as active subjects participating in the decisions that form and shape their personality.
