Abstract

This paper analyses the problem of whether real-estate companies must necessarily be set up as commercial partnerships or whether they may be organised as civil partnerships. The examination is conducted in the light of the different treatment that may be observed in Supreme Court case law, in the decisions of the Directorate-General of Registries and Notarial Affairs and in the doctrine addressing the proposed topic.
