Abstract

Polygamy is not just contrary to Spanish legislation. It is repugnant to Spain's public order, and the public order always constitutes an insurmountable constraint on the efficacy of foreign law (Civil Code, art. 12.3). It is perfectly lawful for the Spanish authorities to regard someone whose marital status constitutes an attack on the public order in Spain not to have accredited «a sufficient degree of integration into Spanish society».
