INTERPRETACIÓN DEL TESTAMENTO: INTENCIÓN Y VOLUNTAD DEL TESTADOR.

Abstract

In the interpretation of a will, the point to seek is the decedent's wishes as stated in the will considered as a whole. Interpreting wills is the task of trial courts and is to be maintained upon appeal to a higher court. Otherwise the appeal would become a third instance of the suit. The Supreme Court must only rule when the solutions given are illogical, absurd or contrary to the testator's wishes as stated in the will.
