The electronic Property Registry, a consolidated reality within the Spanish legal system

Law 11/2023, of May 8, marks a milestone in the evolution of the Spanish land registration system by consolidating the Electronic Land Registry as an integral part of the legal framework. This transformation is examined from its early stages in the registry office to the implementation of the electronic folio, a key component that replaces the traditional paper-based format. This digitalization responds to the need to modernize the registry institution, ensuring greater efficiency, security, and accessibility. The analysis highlights the significant progress brought about by this legal reform and provides a detailed examination of the various technological tools that will be made available to the Land Registry, as well as how the institution’s internal operations will be affected. The new digital environment has brought about substantial changes in the daily operations of registry offices. However, despite the technological advances, the physical presence of the registrar remains essential. The electronic Property Registry is no longer a future aspiration, but a consolidated reality that strengthens legal security in Spanish real estate transactions, without abandoning the traditional mortgage values and principles of the registry system.
