LA IMPLANTACIÓN DEL DIVORCIO POR MUTUO ACUERDO ANTE NOTARIO EN ESPAÑA.

Resumen
En los últimos tiempos, las necesidades de agilización de la Justicia han propiciado una serie de propuestas lege ferenda destinadas a la desjudicialización de algunos procesos. En especial, de aquellos procesos en los que se observa una ausencia del principio contradictorio, encuadrables dentro de lo que se denomina la jurisdicción voluntaria. En este sentido, desde instancias políticas, se ha propuesto la atribución a los notarios de la competencia de los divorcios por mutuo acuerdo. Se trata de una solución que ya se ha implantado en otros países, principalmente del ámbito iberoamericano. En este trabajo se hace un análisis de estas regulaciones con el fin de conocer las diversas opciones existentes y la posibilidad de su establecimiento en nuestro Derecho. Además, se estudian las implicaciones que la competencia notarial tiene respecto de algunas cuestiones de Derecho Sustantivo: la constitucionalidad de la medida, la posibilidad de su implantación cuando haya hijos menores o incapacitados -lo que afecta a la posible competencia del Ministerio Fiscal-, la consideración de la labor notarial como un supuesto de mediación, a la luz de la nueva regulación sobre esta materia; y, en fin, la concurrencia del Notariado y de la abogacía en los procedimientos de divorcio por mutuo acuerdo. Con todo ello, se pretende formar la opinión final sobre la virtualidad y beneficios que la implantación del divorcio notarial, por mutuo acuerdo, produciría en el Derecho español, tanto por razones de economía procesal y agilización de la Administración de Justicia como por motivos de protección de los derechos e intereses de la ciudadanía.
Abstract
In recent times it has become clear that the justice system is choked with backlog. The need to break through has favoured a series of de lege ferenda proposals aiming to de-judicialize certain kinds of proceedings, especially proceedings to which the adversarial process does not pertain. Proceedings of this type may be classified as belonging to what is termed «voluntary jurisdiction ». In this sense, political authorities have proposed vesting notaries with the competence to conduct proceedings in uncontested divorces. The solution is one that has already been introduced in other countries, especially in Latin America. Notarial divorce regulations are analyzed to ascertain what the various options are and whether or not notarial divorce can be established in Spanish legislation. The implications that notarial competence has with respect to some issues of substantive law are looked into: the constitutionality of the measure, the possibility of employing it when there are underage or incapacitated children involved (cases that might impinge on the public prosecutor's powers), the consideration of the notary's task as one of mediation in the light of the new mediation regulation and the concurrence of notaries and attorneys in uncontested divorce proceedings. If uncontested divorce via notary were to be introduced, how effective could it be under Spanish law? What benefits would it bring in terms of economizing time and cost of procedure and in terms of the protection of citizens' rights and interests? A final opinion on the matter is offered.
