Resumen
Cuando existe una ausencia de comunicación y de relación de la abuela con su hija durante muchos años, y esta se ha cronificado, incluso si la hija, madre de los menores, tiene una percepción de haber sido víctima de maltrato por parte de su madre mostrando un temor insuperable hacia ella sin ser posible la restauración de la relación, se deniega el derecho de visitas entre la abuela y los menores con base a la existencia de justa causa, a contrario sensu, del artículo 160 Código civil al poner el acento en el interés superior del menor. Se considera que se coloca a los menores en una situación de vulnerabilidad importante, pues se les sitúa en medio de un conflicto grave, que afecta a su desarrollo ya que carecen de herramientas para gestionar dicha situación.
Abstract
When there is an absence of communication and relationship of the grandmother with her daughter for many years, and this has been chronicled, even if the daughter, mother of the minors, has a perception of having been victim of abuse by her mother showing an insurmountable fear towards her without the restoration of the relationship being possible, the right of visits between grandmother and minors is denied by emphasizing the best interests of the minor. It is considered that minors are placed in a situation of vulnerability, since they are placed in the middle of a serious conflict, which affects their development.
