Resumen
Este trabajo aborda el tema de la cláusula de gastos a cargo del prestatario en los contratos de préstamo hipotecario para la adquisición de vivienda. A través del mismo, se pretenden exponer las causas por las que la sentencia de 23 de diciembre de 2015 ha generado en la jurisprudencia menor una importante diversidad de criterios en torno a los efectos jurídicos derivados de la nulidad de la cláusula, y que son: las razones en las que la sentencia funda la nulidad de la cláusula y los límites inherentes al procedimiento en el que se resolvió el recurso de casación. la situación de diversidad jurisprudencial ha requerido varios pronunciamientos del Tribunal Supremo, el último en enero de 2019, dirigidos a matizar la sentencia de 23 de diciembre de 2015. en esta línea resulta relevante destacar que incluso se pretendió modificar la doctrina sobre quién es el sujeto pasivo del impuesto de actos jurídicos documentados. Por último, en el trabajo se reflexiona sobre la inadecuación del criterio del Tribunal Supremo en el que ampara la nulidad de la cláusula de gastos y se compara con la respuesta que el legislador ha proporcionado a los gastos hipotecarios, a través de la ley de crédito inmobiliario.
Abstract
This paper present the issue of the mortage expenses in the mortgage loan contracts for the acquisition of housing. Through this study, we will expose the causes because the Sentence of 23 December 2015 by the Spanish Supreme Court has generated in the others Spanish courts, an important diversity of criterion about legal effects derived from the nullity of the clause, and that are: the reasons on which the judgment bases the nullity of the clause and the inherent limits to the judicial process in which the appeal was resolved. The situation about diversity of criterion has even generated that the Supreme Court has had to pronounce later, to qualify this resolution and, even modify its doctrine about taxpayer. Finally, the study reflects on the inadequacy of the Supreme Court’s criterion in which it argue the nullity of the mortage expenses and analyzes the treatment that the legislator has provided to the expenses through the Real Estate Credit Bill.
