Resumen
En las sentencias del Tribunal Supremo, de 8 y 9 de enero de 2013, se niega el carácter sinalagmático del swap de intereses en contra de la genuina concepción de la naturaleza jurídica de este tipo de instrumentos financieros y de la propia esencia bilateral y sinalagmática de los mismos.
Abstract
The Supreme Court's rulings of 8 and 9 January 2013 deny the synallagmatic nature of interest rate swaps. These decisions disregard the genuine conception of swaps' legal nature and the very nature of swaps as bilateral synallagmatic financial instruments.
