Resumen
El problema relativo a la determinación de la deuda a la que debe aplicarse el pago, en el supuesto de que existiesen varias homogéneas a favor de un mismo acreedor, y la prestación efectuada no fuese suficiente para la íntegra cobertura de todas ellas, cuenta en el Derecho actualmente vigente con regulación específica en distintos cuerpos normativos. Centrándonos específicamente en el régimen de imputación general contenido en los artículos 1172 a 1174 del Código Civil, cabe indicar que su aplicación práctica puede plantear más problemas de los que podrían deducirse a partir de su simple lectura, debido a ciertas dificultades interpretativas que suscita su actual redacción. En el presente trabajo, tras analizar el régimen legal, se concluye con una propuesta de redacción a través de la cual podrían obviarse buena parte de las dificultades anteriormente reseñadas.
Abstract
If a creditor is owed several homogeneous debts and receives a payment insufficient to cover them all in full, the creditor has a problem. How can the creditor ascertain the debt to which the payment should be applied? There are specific regulations in different parts of current legislation that address the issue. Practical application of the general allocation procedure in articles 1172 to 1174 of the Civil Code may pose more problems than one might think upon just a cursory examination, due to certain difficulties of interpretation stemming from the Code's current wording. In this paper the procedure stipulated by law is examined and a wording is proposed that could eliminate a good many of the difficulties.
