Resumen
Como consecuencia de la globalización y de la libre circulación de personas, las sucesiones se han internacionalizado, lo que ha propiciado que la UE mediante el reglamento 650/2012, de 4 de julio, haya establecido, para regir la sucesión, un sistema de resolución de conflictos sobre el punto de conexión supletorio de la residencia habitual en el momento del fallecimiento. Mediante el ejercicio de la professio iuris el testador puede alterar el punto de conexión y desplazarlo hacia la nacionalidad lo que le permitirá que su libertad en sentido positivo, que su libertad como autonomía en el momento de otorgar el testamento acabe realizándose al haber fijado de antemano la ley por la que se regirá la sucesión; también le supondrá una mayor libertad en sentido negativo, libertad como ausencia de interferencias si la ley de su nacionalidad la comporta.
Abstract
