Resumen
La falta de una legislación estatal que regule las viviendas de uso turístico ha conllevado una discusión sobre la naturaleza jurídica y, con ella, sobre el régimen jurídico aplicable al contrato por el que se cede el uso de este tipo de viviendas. Pese a su consideración mayoritaria como contrato de hospedaje, hay una obligación esencial del hospedero que no le es aplicable al anfitrión de una vivienda de uso turístico: la custodia de los efectos introducidos por los huéspedes.
Abstract
The lack of state legislation that regulates tourist dwellings has led to discussion about the legal nature and, with it, the legal regime applicable to the contract by which the use of this type of housing is transferred. Despite its majority consideration as a accommodation contract, there’s an essential obligation of accommodation that isn’t applicable to the host of a tourist dwellings: the custody of the effects introduced by the guests.
