Resumen

El Registro de la Propiedad, como fuente de publicidad oficial del estado jurídico-real de las fincas, debe recibir todos los actos y negocios que justifiquen un cambio en aquel estado. Los “actos de tráfico” son los ejemplos más claros de ello. Pero no debemos dejar de lado aquellos otros casos en que los derechos inmobiliarios se mueven, no porque “avancen” en el circuito inmobiliario, sino porque “retroceden”, volviendo sobre sus pasos. Ello puede obedecer a distintas razones, que en todo caso ponen de manifiesto una estrecha imbricación entre del derecho de obligaciones y los derechos reales.   La causa por la que haya de operar un retroceso patrimonial es lo que determina el alcance de dicho retroceso, su naturaleza, y con ello, los efectos frente a los posibles subadquirentes que hayan podido adquirir derechos antes de hacerse efectiva la causa del retroceso patrimonial. El presente trabajo pretende abordar el estudio de estos aspectos, tanto desde el Código Civil como desde la Ley Hipotecaria, considerando 1) las condiciones resolutorias explícitas en general; 2) la condición resolutoria explícita del artículo 1504 del Código Civil en particular; y 3) la resolución por incumplimiento ex artículo 1124 del Código Civil.

Abstract

The Property Registry, as a source of official publicity of the status of the land, must be able to receive all the acts and contracts that justify a change in that status. The contracts and similar acts in the traffic are the clearest examples of this. But we must take account other cases in which real estate rights move, not because they "advance" in the real estate circuit, but because they "go backwards”. This “going backwards” may be due to different reasons, which reveal a close overlap between the “Law of obligations” and “Law of property”.    The scope of this “going backwards”, its nature and its effects over the sub-purchasers, it is determined by its cause. The present work tries to approach the study of these aspects, both from the Civil Code and from the Mortgage Law, considering 1) the explicit resolution conditions in general; 2) the explicit resolutive condition of article 1504 of the Civil Code in particular; and 3) the resolution for non-compliance ex article 1124 of the Civil Code.
