Resumen
El objeto de este trabajo es analizar la ordenación de los llamamientos a los reservatarios, en la disciplina de la reserva lineal (art. 811 CC), considerando especialmente el juego del derecho de representación, así como estudiar hasta qué punto el límite de los beneficiarios de la reserva «hasta el tercer grado» de parentesco pertenecientes a la línea de donde los bienes (objeto de la reserva) procedan, supone un límite tanto al juego del derecho de representación sucesoria, como a la transmisión del ius delationis prevista en el artículo 1006 del Código civil. La abundante doctrina, y la mucho menos numerosa jurisprudencia, permiten llegar a soluciones muy razonables, y a trazar el esquema que puede predecir la solución a otros aspectos que aún no han sido abordados por nuestro Tribunal Supremo. el estudio de dicha jurisprudencia y doctrina, y su análisis crítico son, pues, las herramientas principales aquí empleadas.
Abstract
The purpose of this paper is to analyze the ordering of appeals to beneficiaries of the linear reservation (article 811 of the Civil Code), especially considering the role of the «right of representation», as well as to study to what extent the limit of the beneficiaries of the reserve «up to the third degree» of family relationship, and they belong to the line where the goods (object of the reservation) come from, suppose both to the game of the right of representation, and to the transmission of the ius delationis foreseen in the article 1006 of the Civil Code. The doctrine and the (much less numerous) jurisprudence allow to show very reasonable solutions, and to trace the scheme that can predict the solution to other aspects that have not yet been addressed by our Supreme Court. The study of this jurisprudence and doctrine, and its critical analysis are, so, the main points of reference.
