Resumen
La atribución de la custodia exclusiva de un menor a uno de sus progenitores, no confiere al progenitor custodio la facultad de decidir su traslado de residencia sino que necesitará del previo consentimiento del no custodio o, en su defecto, de la supletoria autorización judicial.
Continuidad en la atribución de la guarda y custodia de los hijos a la madre pese a su traslado al extranjero, consecuencia de la mayor vinculación de los menores con la madre y adopción de las medidas necesarias para mantener al máximo la actual relación de aquellos con el padre otorgándole un amplio régimen de visitas.
Abstract
The assignment of exclusive custody of a minor to one of the minor's parents does not give the custodian parent the power to change residence without prior consent from the non-custodian parent or, in lieu thereof, supplementary authorisation from the courts.
Continuity in the assignment of the guardianship and custody of certain children to their mother, despite her moving abroad, as a consequence of the minors' stronger maternal bond, and taking of the necessary measures to maintain the children's current relationship with their father as much as possible by granting him broad visiting rights.
