Resumen
Los problemas y consecuencias jurídicas derivadas de la errónea identificación de fincas registrales y de parcelas catastrales son frecuentes en la generalidad de los países. Las fincas suelen estar deficientemente identificadas en muchos casos, ya que la delimitación y linderos establecidos en el Registro no coinciden con los límites territoriales actuales consecuencia, en la mayoría de los casos, de los precisos métodos de medición actuales y de la aplicación de procedimientos de identificación por satélite. Las parcelas catastrales, en otras ocasiones, no están claramente identificadas en cuanto a la titularidad del bien, ello origina discrepancias entre registro y catastro que derivan en procedimientos de rectificación catastral y registral.
Abstract
The problems and legal consequences of the erroneous identification of property registration and cadastral plots are common in most of the countries. Farms are often poorly identified in many cases because the definition and boundaries set in the registry do not match the current territorial boundaries result, in most cases, the precise current measurement methods and application procedures satellite identification. The land parcels in the past, not clearly identified as to ownership of the property, this results in discrepancies between registry and cadastre procedures that result in cadastral and registration correction.
