Resumen
El Código Civil en sede cumplimiento prevé, en su artículo 1158, las circunstancias del caso del tercero que se decide a pagar por el sujeto pasivo. En dicho supuesto, cobra especial relevancia, no tanto la actitud del acreedor —que carece de posibilidades técnicas para impedir el pago y satisfacción de su derecho por parte de un tercero ajeno— como la adoptada por el deudor, habida cuenta de que, en función de su expresa oposición, su ignorancia o su aquiescencia a la intervención del tercero, dispondrá de distintas acciones y repertorio legales para oponerse eficazmente a las pretensiones resarcitorias de quien cumplió por él. De modo que la acción de reembolso solo procederá si el pago se realiza por cuenta de otro y en su nombre, sin que en ningún caso deba ser reintegrada la obligación de quien la asumió como propia, siendo por tanto de su exclusiva incumbencia la responsabilidad y cumplimiento de la deuda.
Abstract
The Civil Code their article 1158, study the circumstances of the case of the third decides to pay for the passive debitor. In this supposition, have special relevance, the attitude adopted by the debtor. In function of their expressed opposition, their ignorance or their acquiescence to the intervention of the third, it will have different actions and legal repertoire to oppose you efficiently. So, the action will proceed if the payment is carried out for bill of other and on its behalf. In any case the obligation should be return of who assumed it as own, being therefore of its exclusive incumbency the responsibility and execution of the debt.
