Resumen
El sistema tabular australiano, denominado Torrens system, regula una serie de excepciones que limitan la protección del titular registral. Dos de ellas son la existencia de un título previo contradictorio y la errónea descripción física de la finca. Aunque se trata de excepciones independientes, en determinadas situaciones pueden actuar deforma conjunta. En ocasiones este solapamiento no presenta problemas, ya que presentan soluciones idénticas. Sin embargo, en otras situaciones las soluciones no son coherentes entre sí o con el sistema. La cuestión radica en determinar cuál de las soluciones es más justa y debe ser aplicada preferentemente. El artículo se centra fundamentalmente en la solución australiana a estos problemas pero también examina la coherencia de esa solución con el Derecho español.
Abstract
The Australian Torrens system provides several exceptions to the indefeasibility of title enjoyed by a registered pro-prietor. Two of these exceptions, are the «prior certificate of title» exception and the «wrong description of land» exception. These two exceptions have their own sphere of operation. However, there are instances in which they may overlap. In some of these cases the overlap is not problematic. In other cases the application of the two exceptions may result in inappropriate or even quite different out-comes. In cases of inconsistent outcomes, which exception should have ascendancy and determine the outcome of the dispute? This article examines this contentious area in Australian Law and, in doing so, provides some relevant comparative perspectives for Spanish Law.
