PROPICIAR Y FACILITAR LAS INSCRIPCIONES EN EL PROCEDIMIENTO REGISTRAL PERUANO.

Resumen
La idea de propiciar y facilitar las inscripciones constituye una finalidad objetiva dispuesta en el TUO del Reglamento General de los Registros Públicos. El medio para obtener esa finalidad es a través de la actividad interpretativa de las instancias registrales (Registrador Público y Tribunal Registral). Partiendo de una postura de indeterminación parcial del Derecho, la actividad interpretativa no se producirá en todos los casos, sino solo en los casos «difíciles». Para ello se propone que tenga preponderancia la interpretación teleológica, el principio implícito de propiciar y facilitar las inscripciones y el principio administrativo de eficacia. De esta manera, se acentúa o privilegia la circulación de los bienes para facilitar que los activos de las personas lleven una vida paralela como capital y lograr el desarrollo económico.
Abstract
The idea of propitiating and facilitating registration constitutes an objective purpose that is given in the Sole Organized Text of the General Regulation on Public Registers. The means for attaining this objective is the interpretative activity of the registration authorities (public registrar and Court of Registration). Starting from a posture regarding the law as partially indeterminate, interpretative activity will not be forthcoming in all cases, but only in the «tough» ones. For that purpose, it is proposed that the teleological interpretation, the implicit rule of propitiating and facilitating registration and the administrative rule of efficacy, take preponderance. Thus asset circulation is accentuated or accorded privileges, to make it easier for people's assets to lead a parallel life as capital and to achieve economic development.
