Resumen
La renuncia es una facultad que tiene cualquier titular de un derecho. Cuando esta se ejercita sobre un bien inmueble se produce el abandono y el bien pasa a ser propiedad del Estado. La confusa normativa administrativa provoca problemas desde el punto de vista civil y complica la situación registral de los bienes que han sido abandonados poniendo a los registradores de la propiedad ante situaciones de difícil solución.
Abstract
The holder of any right has the legal power to waiver or relinquish it. when this right is exercised regarding real estate assets, abandon- ment occurs, and the immovable property becomes State-owned. The confusing administrative regulation is problematic from a civil law perspective, and further complicates the registry situation of abandoned property, giving rise to challenging situations for property registrars to solve.
