Resumen
En este trabajo pretendemos aclarar el porqué del artículo 179 RH, que exige un especial consentimiento del acreedor hipotecario -que debe constar en escritura pública- para cancelar la hipoteca extinguida previo pago de la obligación que garantiza. Si al pagarse el préstamo garantizado, se extingue de forma automática la hipoteca que lo asegura por razón de accesoriedad, pues esta no puede vivir sin aquel, no se entiende que sea necesario un especial consentimiento «extra» en el acreedor para poder poner fin a la existencia registral de dicha hipoteca mediante la cancelación del asiento. Analizamos el origen histórico y la interpretación jurisprudencial que ha hecho la DGRN de este artículo para tratar de entender su justificación y su sentido, cuando, a priori, debería cancelarse de forma automática el asiento de hipoteca que la recoge, al extinguirse directamente y por razón de accesoriedad de dicho préstamo garantizado.
Abstract
This paper examines why the article 179 RH, which requires special consent of the mortgagee, to cancel publicly extinguished mortgage upon payment of the obligation it secures. If by paying the secured loan, the mortgage is extinguished automatically because of its incidental nature, as the mortgage can not live without the loan, it is not clear that an «extra» special consent on the creditor is required to end the existence of such mortgage registration by cancel. We analyze the historical origin and judicial interpretation has done DGRN of this article to try to understand their justification and sense when, a priori, should be canceled automatically, to die directly, because of its dependence of the secured loan.
