Resumen
La pensión compensatoria ha evolucionado de forma sustancial desde su instauración en el año 1981 hasta nuestros días, pasando de su inicial carácter vitalicio y cuya beneficiaria era generalmente la mujer, a las tendencias actuales, más acordes con la sociedad española del siglo XXI. El presupuesto necesario tanto hoy como en sus inicios sigue siendo el desequilibrio económico, concepto jurídico indeterminado que hay que poner en relación con las restantes obligaciones o cargas familiares a las que deben hacer frente los miembros de la extinta pareja, sobre todo cuando existen menores implicados. El objetivo último ha de ser extender la corresponsabilidad parental también al terreno patrimonial.
Abstract
Alimony has evolved substantially since its inception in 1981 to the present day, from its initial life tenure and whose beneficiary was generally women, current trends, more in line with the Spanish society of XXI century. The budget needed today and in the beginning is still the economic imbalance, vague legal concept to be put in relation to other obligations or family responsibilities to those faced by members of the former couple, especially when there are children involved. The ultimate goal must be to extend the parental responsibility also to patrimonial field.
