NOVEDADES EN MATERIA DE ASUNCIÓN ESTATAL DE RESPONSABILIDAD Y TRANSMISIÓN DE ACCIONES CIVILES POR TERRORISMO: EL RÉGIMEN JURÍDICO DEL RESARCIMIENTO, SEGÚN LA LEY 29/2011, DE 22 DE SEPTIEMBRE, DE RECONOCIMIENTO Y PROTECCIÓN INTEGRAL DE LAS VÍCTIMAS DEL TERRORISMO.

Resumen

La Ley 29/2011, de 22 de septiembre, de Reconocimiento y protección integral de las víctimas del terrorismo, ha aprobado ciertas novedades en el régimen de indemnizaciones, ayudas, prestaciones, garantías y condecoraciones. De este modo, además de definir la acción terrorista, incluye entre sus víctimas a quienes hayan sufrido daños, aun cuando sus responsables no sean personas adscritas a organizaciones o grupos criminales. Asimismo, la regulación tendrá aplicación retroactiva a quienes ya hubieran obtenido ayudas e indemnizaciones inferiores a las establecidas en su Anexo primero, cuyo plazo comenzará a computarse a partir del año de la publicación del Reglamento de la Ley. Por tanto, en estas líneas se revisará el régimen jurídico legal en materia de resarcimiento, así como las especialidades fijadas por el Tribunal Constitucional, la Sala de lo Civil y la de lo Penal del Tribunal Supremo y, por lo que se refiere a la Audiencia Nacional, su Sala de lo Contencioso-Administrativo y Penal.

Abstract

Act 29/2011 of 22 September on acknowledgement and comprehensive protection for the victims of terrorism has approved certain new developments in the damage, aid, benefit, guarantee and decoration procedure. In addition to defining terrorist action, the act includes people who have been injured among the victims of terrorism, even when the persons responsible for that injury are not members of criminal groups or organizations. In addition, the regulation implementing the act will be applied retroactively to people who have already obtained aid and damages of sums lower than those established in Annex One, under a deadline whose countdown will begin in the year when the regulation is published. So, this paper will review the legal framework in matters of redress and the special features established by the Constitutional Court, the Civil Division and the Criminal Division of the Supreme Court and the Administrative and Criminal Division of the National Court.
