Resumen
En los últimos años se han ido sucediendo las resoluciones judiciales en relación con las cláusulas abusivas, y particularmente sobre las cláusulas suelo. uno de los últimos capítulos en esta historia ha sido la STS de 11 de abril de 2018 en relación con el documento privado novatorio de la cláusula suelo incluyendo una renuncia general de acciones por parte de los prestatarios. en esta sentencia, el Tribunal Supremo se aparta de la doctrina iniciada en relación con estos acuerdos privados en la STS de 16 de octubre de 2017.
Abstract
In the last few years have been following one after another the judgments in relation to abusive clauses, and particularly to floor clauses. One of the last chapters in this story has been the STS 11 April 2018 in connection with the novatory private document of the floor clause including a general waiver of actions by the borrowers. In this resolution, the Supreme Court deviates from the doctrine initiated in relation to these private agreements in the STS 16 October 2017.
