Resumen
En el proceso de formación del contrato se presenta la figura de los tratos preliminares con especial protagonismo. De ahí el interés en determinar algunos aspectos sobre el particular a la luz del Derecho Comparado: cuál es su naturaleza jurídica; su relevancia jurídica; la posible conexión con el principio general de la buena fe contractual; así como también su delimitación con el contrato mismo.
Abstract
In the process of formation of the contract figure presents preliminary dealings of special importance. Hence the interest in determining some aspects on the subject respect to comparative law: what is its status legal; its legal significance; the possible connection with the general principle of good faith contractual; as well as its boundary with the contract itself.
