Resumen
La declaración de desamparo y asunción de la tutela por entidad pública conlleva la suspensión de la patria potestad. El derecho de los padres a relacionarse con sus hijos subsiste en caso de acogimiento familiar. Únicamente se suspenderá o se restringirá por resolución judicial o, cautelarmente, por resolución de la Delegación Provincial que ejerce la tutela administrativa si la gravedad de la situación lo requiere y el interés del menor lo aconseja.
Abstract
When a minor is declared abandoned and is put under the guardianship of a public agency, parental authority is suspended. When children are put into a foster home, their parents continue to hold the right to engage in a relationship with them. The parents' right will be suspended or restricted only by court order or as a precautionary measure taken by the provincial bureau holding administrative authority over the children, if the situation is serious enough to so require and if it is in the children's best interests to do so.
