LUCES Y SOMBRAS DE LA FE PÚBLICA REGISTRAL EN EL DERECHO AUSTRIACO.

Resumen
Dentro del heterogéneo panorama registral europeo, el sistema austriaco, casi inadvertido para nuestra doctrina, permite un interesante análisis del efecto más paradigmático de los modelos de inspiración germánica: la fe pública registral.
En Austria coexiste un registro con libro de inscripciones y depósito de documentos y otros registros de carácter más residual en los que únicamente se depositan los documentos sin reconocerse el efecto de fe pública registral. La inscripción, frente al mero depósito, se configura así como el elemento determinante de este particular efecto, pero a pesar de esta clara definición de los conceptos que permite delimitar los casos en que se justifica la existencia de la fe pública registral, se advierten otros aspectos sombríos en relación con este efecto. La estructura dual del registro, integrado por un libro de inscripciones y una colección de documentos en la que se depositan todos aquéllos que sirvieron de base para la inscripción, hace difícil delimitar los contornos de la fe pública registral, que indudablemente alcanza al libro de inscripciones, pero se discute hasta qué punto puede llegar a impregnar al propio documento que sirvió de base para la inscripción y que, al integrarse en el contenido del registro, goza de la publicidad propia del mismo. A través del presente estudio se formula un esbozo del sistema registral austriaco, dedicando una especial atención a estas cuestiones.
Abstract
On the heterogeneous landscape of European registration, the Austrian system, which Spanish doctrine almost completely overlooks, affords the opportunity for an interesting analysis of the most paradigmatic effect of Germanic models: registrar-attested document authenticity.
Austria has a registry with an entry book and document-posting facilities, which coexists with residual registries where documents are merely posted without recognition of authenticity. Thus, registration entry, as opposed to mere posting, is configured as the key element of this particular effect. However, despite this clear definition of the concepts (thanks to which the justified cases of registrarattested document authenticity can be delimited), there are other, darker aspects related with this effect as well. The dual structure of the registry, which is made up of an entry book and a collection where all documents used as the basis for entry are posted, makes it difficult to map out the contours of registrarattested document authenticity. The entry book is indubitably covered by registrarattested document authenticity, but there is some debate about the extent to which registrar-attested document authenticity can pertain to the actual document upon which an entry has been based, which document, upon becoming part of the registry's contents, enjoys registry disclosure.
