Resumen

Daño moral sufrido por quien descubre que no es suyo un hijo nacido durante su matrimonio. Consta negligencia de la esposa en la procreación del hijo y dolo al ocultar a su entonces marido su no paternidad del niño, y al permitir que, conociendo que no era hijo suyo, y pese las dudas que aquél le puso de manifiesto, fuese inscrito como propio en el Registro, se le fijaran alimentos en la separación y se instara un proceso de impugnación de la paternidad.

Abstract

Mental anguish suffered by a man who discovers that a child born during his marriage does not belong to him.
There is evidence of the wife's negligence in the procreation of the child and her fraudulent intent in concealing from her then-husband his nonpaternity of the child and in permitting the child to be registered as his in the knowledge that it was not his child, despite her husband's stated doubts.
Support payments will be established in the separation and a challenge of paternity will be filed.
