Resumen
En este trabajo se analiza la problemática consistente en si las sociedades inmobiliarias han de configurarse necesariamente como sociedades mercantiles, o bien, pueden adoptar la tipología de la sociedad civil. Todo ello, a la luz del diferente tratamiento que puede apreciarse en la Jurisprudencia del Tribunal Supremo, en las Resoluciones de la Dirección General de los Registros y del Notariado, así como en la doctrina que ha abordado el tema propuesto.
Abstract
This paper analyses the problem of whether real-estate companies must necessarily be set up as commercial partnerships or whether they may be organised as civil partnerships. The examination is conducted in the light of the different treatment that may be observed in Supreme Court case law, in the decisions of the Directorate-General of Registries and Notarial Affairs and in the doctrine addressing the proposed topic.
