Resumen
Las reservas de aprovechamiento y su acceso al Registro de la Propiedad son objeto de la Resolución de 22 de julio de 2016, la cual acertadamente reconoce su recepción implícita en el Real Decreto 1093/1997, de 4 de julio, al ocuparse en su artículo 39 de la posibilidad de apertura de folio registral independiente al aprovechamiento subjetivo reconocido a los propietarios de suelos afectos a redes públicas que son objeto de obtención ya sea por expropiación forzosa a cambio de finca futura, ya sea por ocupación directa, lo cual, por otro lado, revela el verdadero alcance de la regulación contenida al respecto en la Ley aplicada en el caso por ella tratado, la Ley 5/2014, de 25 de julio, de ordenación del Territorio, Urbanismo y Paisaje, de la Comunidad Valenciana, destacable no tanto por su alcance novedoso, realmente menor, sino, más bien, por ofrecer una exposición unificada en su artículo 79 de una de las manifestaciones de tales procedimientos.
Abstract
The building rights and their registering in the Land Registry are analized by the decision of 22 July 2016, which rightly acknowledges it is implicitly allowed by the Royal Decree 1093/1997. It's article 39 allows the independient registration of the building rights which belong to owners of lands affected by public networks which are subject to acquisition either via expropriation in exchange for a future plot or via direct occupation.This fact, on the other hand, reveals the exact extend of the regulations contained in the Act 5/2014, of the Valencian Community, which stands out for contaning an unified regulation for one of the manifestations of such procedures.
