Resumen
Las artes escénicas generan derechos de propiedad intelectual de distinta naturaleza.
Por un lado, los derechos de autor que corresponden a quien crea la obra que se representa o se pone en escena.
Por otro, los derechos afines que se atribuyen a los artistas intérpretes o ejecutantes, a los cuales se asimilan el director de escena y orquesta, que posibilitan el disfrute natural de la obra mediante su representación por parte del público que asiste al espectáculo. Ambos confluyen sobre una misma realidad o estereotipo. Concurrencia que en ocasiones genera conflictos entre sus respectivos titulares, es decir, entre los autores y los artistas. La concentración de ambos derechos en la figura del empresario teatral mediante los llamados contratos escénicos delimita las posiciones de los protagonistas que intervienen en la obra y en su representación, haciendo posible la puesta en escena de la obra.
Abstract
The dramatic arts generate intellectual property rights of a different nature.
First, the copyright belongs to whoever created the work that is being performed or staged. Then, there are similar rights for the performers or stagers, such as the producer and orchestra, whose action makes it possible for the attending audience to gain a natural enjoyment of the show. Both meet in the same reality or stereotype. This meeting sometimes generates conflicts between the respective holders of the two types of rights, i.e., between authors and performers. The concentration of both rights in the figure of the theatrical impresario by means of what are called «stage contracts» delimits the positions of the major players taking part in the work and its performance, making it possible to stage the work.
