LA TERMINACIÓN DE LA RELACIÓN ARRENDATICIA RÚSTICA Y SUS EFECTOS A LA LUZ DE LA LEY DE ARRENDAMIENTOS RÚSTICOS.

Resumen
La terminación de la relación arrendaticia rústica y sus efectos se hayan regulados en los artículos 24 a 27 de la LAR, distiguiendo tres figuras jurídicas distintas: terminación, resolución y rescisión. Hemos analizado las causas determinantes de cada una de ellas, a las cuales hay que añadir las que las partes contratantes hayan expresamente acordado, rigiendo con carácter supletorio el Código Civil. También hemos analizado los efectos derivados de dicha terminación, en cuyo caso el arrendatario saliente debe permitir al entrante el uso del local y demás medios necesarios para las labores preparatorias del año siguiente y recíprocamente el entrante tiene obligación de permitir al saliente lo necesario para la recolección y aprovechamiento de los frutos en la forma prevista en el artículo 1.578 del Código Civil.
Abstract
The termination of a rural lease relationship and its effects are regulated in sections 24 to 27 of the Rural Lease Act. The act distinguishes between three different legal concepts: termination, cancellation and rescission. We have analysed the causes at the root of each, to which causes must be added any causes that the parties to the lease have expressly agreed to.
The Civil Code is applied as a supplementary framework. We have also analysed the effects stemming from the termination of a rural lease, in which case the outgoing tenant must allow the incoming tenant to use the premises and other means necessary for the following year's preparatory work, and reciprocally the incoming tenant is obligated to allow the outgoing tenant all that is necessary to gather and use the fruits of his labour as provided for in article 1578 of the Civil Code.
