Resumen
La sentencia de la Sección 1.ª de la Audiencia Provincial de Valladolid, de 11 de abril de 2006, resuelve un interesante caso en el que, tras un testamento notarial abierto, se realiza por la testadora un testamento ológrafo en que varía la designación de heredero, si bien condicionada a la circunstancia de que «si me ocurriera algún accidente». A raíz de esta concreta sentencia, estudiamos en el presente artículo el régimen jurídico existente en caso de realización de varios testamentos sucesivos por un mismo testador y la relación entre ellos, en especial la posible concurrencia de una revocación tácita, y realizamos un pequeño comentario a la misma.
Abstract
The Valladolid Provincial Court (Section 1) Judgment of April 11st 2006 resolves an interesting case where, after a notarized open testament, is made by the testator a handwritten testament in which she modifies the heir designation, although subject to the circumstance of «if an accident happened to me». Following this particular judgment, in this article we study the legal regime existing in case of carrying out several successive testaments by the same testator, and which is the relationship between them, especially the possible existence of a tacit revocation, making also a brief comment on it.
