Resumen
La Audiencia Provincial de Asturias y la Audiencia Provincial de Cantabria, incorrectamente, han dictado unos criterios afirmando que en el mercado primario y secundario, la Ley 11/2015 y la Directiva 2014/59 y el Reglamento UE de 15 de julio de 2014 impiden conceder una indemnización a los inversores del mercado secundario por la amortización de las acciones del Banco Popular efectuada por la JUR.
Abstract
The Provincial Court of Asturias and the Provincial Court of Cantabria, incorrectly, have issued criteria stating that in the primary and secondary market, Law 11/2015 and Directive 2014/59 and Regulation EU of 15-7-14 prevent granting compensation to secondary market investors for the redemption of Banco Popular shares by the JUR.
