Resumen
El Código Civil establece una responsabilidad subjetiva y directa de los padres por los hechos cometidos por los hijos menores de edad, con independencia de la edad de éstos. Actualmente la tendencia global en el ordenamiento es la de ampliar el ámbito de actuación de los menores atendiendo a su progresiva adquisición de la capacidad, sin que exista una correlación en la asunción de deberes y de responsabilidades.
Además la doctrina del Tribunal Supremo se aparta de lo establecido en la norma y consagra una responsabilidad cuasi-objetiva para garantizar siempre el resarcimiento de la víctima, convirtiéndose los padres del causante del daño en la auténtica víctima.
Abstract
The Civil Code states that parents hold direct and subjective liability for acts committed by their underage children, regardless of the children's age.
The current general trend in legislation is to allow the realm of action available to minors to expand in step with their gradual acquisition of capacity, without any correlation in the assumption of duties and liabilities.
Moreover the Supreme Court's doctrine strays from the terms established in the Civil Code and consecrates a quasiobjective liability to guarantee compensation for the victim always, making the parents of the person who inflicts the damage the real victims.
