Resumen
Es preciso atemperar los parámetros establecidos en el Código Civil a la situación actual de los menores de edad, bien a través de los diferentes criterios interpretativos de las normas o con una reforma legislativa que de una vez establezca un criterio global y unánime sobre la responsabilidad derivada de las actuaciones de los menores atendiendo a su capacidad natural de discernimiento, a su formación y a su desarrollo psíquico en estrecha correspondencia con la edad, todo ello en concordancia con los cambios sociales y estructurales que se han producido desde la promulgación de nuestro Código y que ya han tenido reflejo en distintos ámbitos en nuestro ordenamiento.
Abstract
The parameters established in the Civil Code need to be adjusted to the current situation of underage persons. This may be done either through the different criteria for interpreting legislation or through a legislative reform that once and for all sets an overall, unanimous rule on liability stemming from action by minors in view of their natural capacity for discernment, their education and their mental development in close correspondence with their age. Such an adjustment should be made in concordance with the social and structural changes that have happened since the Civil Code was enacted and that have already been reflected in different areas of our legislation
