Resumen
El legislador ha abordado la última reforma de la regulación de la adopción nacional mediante la Ley 26/2015, de 28 de julio, de Modificación del sistema de protección de la infancia y adolescencia y la Ley 15/2015, de 2 de julio, de Jurisdicción Voluntaria, introduciendo ciertos cambios que habían sido reclamados desde distintos estamentos. El objetivo de este trabajo no es el estudio exhaustivo de la regulación actual de la adopción, por exceder de los límites de esta memoria, sino el análisis, a la luz de las interpretaciones doctrinales y jurisprudenciales emitidas desde la promulgación de la nueva normativa, de algunas de las cuestiones más controvertidas que la aplicación práctica ha puesto de manifiesto e intentar poner de relieve la implementación de esta institución. De esta forma, nos ha sido posible observar los aciertos legislativos, así como exponer las deficiencias o carencias de las que, a nuestro juicio, adolece esta regulación. Esta circunstancia nos ha permitido, en su caso, realizar propuestas de lege ferenda para la mejor consecución de su fin último: la integración de los menores que se encuentren en una especial situación de vulnerabilidad en un núcleo familiar de forma estable, creando un estado de filiación entre ellos y los adoptantes.
Abstract
The passage of several years since the reform of the regulation of adoption operated by Law 26/2015, of July 28, of 28 July Amending the system for the protection of children and adolescents and Law 15/2015, of 2 July, on Voluntary Jurisdiction, introducing certain changes that had been demanded from different levels. The objective of this work is not the exhaustive study of the current regulation of adoption, because it exceeds the limits of this report, but the analysis, in the light of the doctrinal and jurisprudential interpretations issued since the promulgation of the new regulations, of some of the most controversial issues that practical application has revealed and try to highlight the implementation of this institution. In this way, it has been possible for us to observe the legislative successes, as well as to expose the deficiencies or shortcomings of which, in our opinion, this regulation suffers. This circumstance has allowed us, where appropriate, make lege ferenda proposals for the best achievement of its ultimate goal: the integration of minors who are in a particularly vulnerable situation in a stable family nucleus, creating a state of filiation between them and the adopters.
