Resumen
La pensión de alimentos adoptada en un proceso de separación o divorcio puede ser objeto de modificación, procediéndose a la reducción de su cuantía, cuando tiene lugar una alteración sustancial de las circunstancias. Uno de los hechos o circunstancias que pueden determinar tal alteración es el nacimiento de nuevos hijos; si bien, como dispone la sentencia del Tribunal Supremo, Sala Primera, de 30 de abril de 2013, en unificación de doctrina, no supone por sí solo causa suficiente para dar lugar a la modificación de las pensiones alimenticias establecidas a favor de los hijos de una anterior relación, sino que es preciso conocer si la capacidad patrimonial o los medios económicos del alimentante son insuficientes para hacer frente a la obligación alimenticia ya impuesta, y a la que resulte de las necesidades de los hijos nacidos con posterioridad.
Abstract
The food in the procedures of separation and divorce they can be an object of modification, they proceeding to the reduction of his quantity, when a substancial alteration of the circumstances takes places. One of the facts or circumstances that can determine such a alteration is the birth of a new son; though since the arranges the judgment of the Supreme Court of April 30, 2013, he does not suppose for if alone sufficient reason to give place to the modification of the food pensions established in favour of the children of a previous relation, but it is necessary to know if the patrimonial capacity or economics means of the father or mother it is insufficient to face to the food already well versed obligation and to the one that ensures from the needs of children born with posteriority.
