Resumen
Las inmisiones en la vivienda familiar, sobre todo los ruidos, aunque también los olores, radiaciones, vibraciones, etc., pueden perturbar la normal convivencia y el disfrute del hogar. Desde el punto de vista jurídico, dichas inmisiones son susceptibles de vulnerar derechos fundamentales de la persona, como el derecho a la intimidad, a la integridad, a la inviolabilidad del domicilio, a una vivienda digna, a la salud, y a un medio ambiente adecuado. Estando la familia compuesta habitualmente por varios miembros, es interesante estudiar quien debe de instar la acción de reclamación oportuna, a fin de evitar que la pretensión se vea rechazada por falta de legitimación activa o falta de litisconsorcio activo necesario. También es de interés el estudio del carácter de la posible indemnización que se obtenga para el caso de que se pruebe que la inmisión ha causado un daño (ganancial o privativa), pues si solo ha sido parte en el procedimiento uno de los miembros del matrimonio y es solo él a quien se reconoce la indemnización, sería importante para liquidar el régimen económico matrimonial ante una eventual crisis.
Abstract
Immissions in the family dwelling, especially the noises, but also the odors, radiations, vibrations, etc., can disrupt the normal coexistence and enjoyment of the home. From the legal point of view, such immissions are liable to violate fundamental rights of the person, such as the right to privacy, integrity, inviolability of the home, decent housing, health, and an adequate environment. Due to the family is usually composed of several members, it is interesting the study of who should urge the action of a timely claim, in order to avoid the claim rejection due to the lack of active legitimacy or lack of active litisconsortium necessary. It's also interesting the study of the nature of the possible compensation that is obtained in the event that it proves that the immission has caused damage (gainful or exclusively), since if only one of the members of the marriage had been part in the procedure and she/he is only he whom is recognized as compensation, would be important to liquidate the matrimonial economic regime in case of crisis.
