Resumen
La sociedad democrática actual se rige por el principio de igualdad de todos los ciudadanos ante la Ley. En relación con la sucesión de títulos nobiliarios, la jurisprudencia, adelantándose a la ley, ha evolucionado del principio de masculinidad -en donde se percibía un trato discriminatorio de la mujer- al principio de primogenitura, criterio objetivo en línea con el principio de igualdad del hombre y de la mujer, y recogido por la reciente Ley de 31 de octubre de 2006.
Abstract
Current democratic society is governed by the principle that all citizens are equal in the eyes of the law. In connection with succession to titles of nobility, jurisprudence, stealing a march on the law, has evolved from the principle of masculinity (under which women receive discriminatory treatment) to the principle of primogeniture, an objective criterion that is in line with the principle of the equality of men and women and was stated in the recent law of 31 October 2006.
