Resumen
A lo largo de los últimos años, la prenda de créditos ha sufrido una serie de modificaciones legales, derivadas de las necesidades del tráfico económico, que realmente han aportado muy poco. Es más, podría decirse, que tales reformas han perjudicado a la figura al no tener en cuenta las demandas que la práctica comercial y financiera exigían ante las deficiencias normativas del Derecho español. Por ello, en este estudio, hacemos un breve recorrido por los puntos más conflictivos de la prenda de créditos con el fín de que el legislador tome nota y comience a pensar en una verdadera y completa reforma de la prenda de créditos, teniendo en cuenta la existencia de objetos diferentes (créditos presentes y futuros, individuales o en grupo); terceros implicados o afectados (deudor cedido y acreedores); y, problemas de impago que pueden llevar al concurso o no.
Abstract
Over the last few years, the lending has undergone a series of legal modifications, derived from the needs of the economic traffic, which have really contributed very little. It is more, one could say, that such reforms have harmed the figure by not taking into account the demands that the commercial and financial practice demanded before the normative deficiencies of the Spanish Law. Therefore, in this study, we make a bnef tour of the most conflictive points of the loan pledge in order for the legislator to take note and start thinking about a true and complete reform of the pledge, taking into account the existence of different objects (present and future, individual or group credits); third parties involved or affected (debtor ceded and creditors); and, problems of non-payment that can lead to the contest or not.
