LA PENSIÓN DE ALIMENTOS DE LOS HIJOS MENORES DE EDAD Y LOS GASTOS EXTRAORDINARIOS.

Resumen
Los padres tienen el deber de prestar a los hijos una completa asistencia en todos los ámbitos; cuando tiene lugar la situación de crisis matrimonial o ruptura de pareja, la obligación de alimentos, en relación a los hijos menores de edad, trasciende a la propia patria potestad, y se funda en la filiación, representando una de las obligaciones de mayor contenido ético del ordenamiento jurídico, con alcance constitucional como establece el artículo 39.1 de la Constitución Española. Sobre el régimen jurídico de la pensión alimenticia, incidiendo en uno de los aspectos de su contenido que más controversia genera como son la cobertura de los gastos extraordinarios, sin obviar su novedosa tramitación procesal, es la materia sobre la que se va a centrar el presente estudio.
Abstract
The parents have the duty to give a complete assistance to the children in all the areas; when there takes place the situation of matrimonial crisis or break of pair the food obligation in relation to the children minors comes out of the own native legal authority, and it is founded on the filiation, representing one of the obligations of major ethical content of the juridical classification, with constitutional scope since it establishes the article 39.1 of the Spanish Constitution. On the juridical regime of the food pension, affecting in one of the aspects of his content that more controversy generates like they are the coverage of the extraordinary expenses, without obviating his new procedural processing, it is the matter on the one that is going to centre on the present study.
