LA PATRIA POTESTAD PRORROGADA O REHABILITADA.

Resumen
La patria potestad puede extinguirse al llegar el hijo a la mayoría de edad, bien mediante la prórroga de aquella, cuando el hijo es incapacitado durante su minoría de edad, o bien mediante su rehabilitación, cuando el hijo también resulta incapacitado, tras su mayoría de edad, y concurran, además, los requisitos de soltería y convivencia con los progenitores. En el presente estudio vamos a analizar ambas modalidades de patria potestad prorrogada, como alternativa a otras instituciones de guarda -tutela y curatela-, tal como se regula en nuestro Código Civil, con especial referencia a las posiciones doctrinales y jurisprudenciales existente sobre la materia, sin perjuicio de proceder, asimismo, a un sucinto tratamiento de la regulación existente en otros ordenamientos nacionales y extranjeros próximos a nuestro entorno.
Abstract
Parental authority may be extended at a child's attainment of majority, either by delaying majority should the child have been incapacitated while a minor, or by reinstating minority should the child be incapacitated after attaining majority and in addition meet the requirements of being unmarried and living in the parental home. This study will look at both means of extending parental authority as an alternative to other protective institutions (guardianship and curatorship), as regulated in our Civil Code. Special reference will be made to the positions currently espoused by legal thought and case-law. A succinct discussion of the regulations existing in other domestic bodies of law and foreign bodies of law akin to ours is included.
