Resumen
Análisis crítico de la jurisprudencia del Tribunal Supremo sobre la partición de la herencia. La jurisprudencia remarca la necesidad de respetar el criterio restrictivo de nuestro ordenamiento jurídico a la hora de admitir pretensiones de invalidez de las particiones.
En la partición convencional existe objeto cuando hay cosa determinada, aunque no esté individualmente concretada.
Abstract
Critical analysis of Supreme Court case law on the partition of estates.
Case law emphasizes the need to respect the restrictive criterion of Spanish law when accepting allegations of partition invalidity. In conventional partition, there is an object when there is a thing at issue, even if the thing is not individually specified.
