Resumen
La infidelidad no es un daño indemnizable, pero sí, en cambio, la procreación con ocultación. El engaño es lo que ha hecho incurrir en responsabilidad a la progenitora. La pérdida de afectos, el vacío emocional subsiguiente al descubrimiento de la verdad biológica es un hecho indemnizable. Conducta que causa un daño consistente en dejar de ser padre real de la menor, y que se materializa en la frustración y en el dolor por la pérdida de la relación paternal considerada existente y del proyecto de vida en común con la menor. Conducta culposa y daño moral ocasionado están relacionados causalmente. Al ser la menor concebida durante el noviazgo pero nacida ya constante matrimonio existe la presunción de hija matrimonial no desvirtuada por las dudas de la madre. La ocultación de las dudas sobre la paternidad no se puede incardinar en el incumplimiento del deber de fidelidad que el artículo 68 del Código civil impone a los casados, ya que para las relaciones de noviazgo no existe regulación legal. No obstante, si uno de los miembros de la pareja realiza una conducta que causa un daño y está causalmente relacionado, es responsable del daño.
Abstract
Infidelity is not compensable, but instead, procreation with concealment. Deception is what has caused the parent to incur responsibility. The loss of affection, the emotional emptiness subsequent to the discovery of biological truth is a compensable fact. Behavior that causes harm consisting in ceasing to be the real father of the minor, and which is materialized in frustration and pain due to the loss of the paternal relationship considered existing and of the life project in common with the minor. Guilty behavior and moral damage caused are causally related. Being the minor conceived during the courtship but born constant marriage there is the presumption of marriage daughter not distorted by the mother’s doubts. The concealment of doubts about paternity cannot be incardinated in the breach of the duty of fidelity that article 68 CC imposes on married people, since there is no legal regulation for dating relationships. However, if one of the partners performs a behavior that causes harm and is causally related, the partner is responsible for the damage.
