Resumen

Del inicial sistema de responsabilidad, fundado en la concurrencia de daño e ilícito civil, tanto el ordenamiento como la jurisprudencia se han inclinado hacia el fundamento objetivo de dicha obligación resarcitoria. Este tipo de responsabilidad civil, de carácter objetivo, se basa en idéntica concurrencia del daño, si bien causado sin culpa y con intención o no de infligir perjuicio. Con todo, sigue siendo presupuesto inexcusable el necesario concurso del nexo entre el daño y la actuación o servicio público en la que se ha ocasionado la lesión o perjuicio. Para determinar esta relación de causalidad, la jurisprudencia ha elaborado y aplicado casuísticamente diversos criterios, como el denominado de la causalidad adecuada o eficiente, donde la condición será irrelevante si hay un encadenamiento extraordinario de circunstancias. En estas líneas se revisará el hostigamiento o acoso de uno o varios estudiantes contra otro alumno o alumna, ocurrido en el seno de los centros docentes públicos y la aplicabilidad del sistema de responsabilidad patrimonial de las Administraciones Públicas, cuyas líneas básicas se sustentan en principios civiles.

Abstract

From the initial system of liability (founded on the attendance of damage and infraction of civil law), both legislation and case-law have pulled away, leaning instead toward an objective foundation for the obligation to provide compensation. This type of objective civil liability is based also on the attendance of damage, albeit damage caused without fault and with or without the intention to do harm. Even so, the necessary concourse of the nexus between the damage and the public service or action where the injury or harm was done remains an inexcusable prerequisite. In order to trace out this causal relationship, case-law has created and casuistically applied various criteria, such as what is called «adequate (or efficient) causality», where the condition is irrelevant if there is an extraordinary chain of circumstances. The author applies these lines to the case of student harassment in public schools and reviews the applicability of the system whereby the public administration is held financially liable, a system whose basic lines rest on civil principles.
