Resumen
La comunidad de bienes de tipo romana es una situación, en principio, transitoria, y destinada a su extinción, fundamentalmente a través de la división de la cosa común. Se plantea en este trabajo si la división de la cosa común que puede pedir un comunero para salir de la situación de indivisión es siempre necesaria o recomendable; o si por el contrario, las excepciones a la misma deberían permitirse e incluso normalizarse, pues, la comunidad de bienes, a veces, no es tan perjudicial como se supone, sino más bien al contrario, es necesaria para la consecución de unos fines determinados.
Abstract
Roman community property is in principle a transitory situation intended to be terminated, fundamentally through the division of the thing join tly owned. This paper addresses the question of whether division of the thing jointly owned at the petition of one of its joint owners in order to sever the situation of undivided ownership is always necessary or recommendable; or whether on the contrary exceptions should be permitted and even normalised, because a community property regime is sometimes not as injurious as one supposes. On the contrary, such a regime may be necessary for the achievement of certain ends.
