Resumen

Tras la reforma introducida en el Código civil por Ley 8/2021, el artículo 808, en la primera oración de su nuevo párrafo cuarto, permite literalmente al testador que tenga descendientes legitimarios con discapacidad «disponer a su favor de la legítima estricta de los demás legitimarios sin discapacidad».

El referido párrafo cuarto continúa con una segunda frase fijando que «En tal caso, salvo disposición contraria del testador, lo así recibido por el hijo beneficiado quedará gravado con sustitución fideicomisaria de residuo…».

Por tanto, a diferencia de la redacción anterior del 808, cuyo párrafo tercero estaba constituido por una sola frase que permitía como único gravamen posible sobre la legítima estricta el de la sustitución fideicomisaria, en la actualidad, el mismo párrafo, ahora cuarto, se divide en dos oraciones diferentes en las que se permite al testador, primero, disponer de ella, para, en segundo lugar, y solo cuando el testador no haya dispuesto otra cosa, fijar como su gravamen el de la sustitución fideicomisaria de residuo.

Por ello, si no cabe duda que con la Ley 41/2003 el legislador permitió por primera vez la tangibilidad de la legítima estricta mediante la sustitución fideicomisaria que se podía establecer sobre la legítima estricta en beneficio de un descendiente incapacitado judicialmente, con la reforma introducida por la Ley 8/2021 podemos afirmar que el legislador actual ha querido dar un paso más, dejando claro de forma expresa que cuando se habla de la protección de las personas con discapacidad la intangibilidad de la legítima estricta carece de sentido, y de ahí que, primero, otorgue al testador con legitimarios con discapacidad la facultad de disponer de la legítima estricta; segundo, apueste por la protección de las personas con discapacidad en vez de las personas con curatela representativa como posibles beneficiarios de toda la herencia, lo cual amplía de forma exponencial no solo los que se pueden proteger con toda la legítima estricta, sino también los que se pueden ver perjudicados con ello; y, tercero,  que haya fijado de forma literal que el gravamen supletorio que recae sobre la legítima estricta faculta al fiduciario con discapacidad a disponer onerosamente de los bienes que la componen, como es la sustitución fideicomisaria de residuo.

Si a todo esto le sumamos que existen ya más de cuatro millones de españoles (navarros, aragoneses y vascos) que libremente pueden privar a sus herederos de su herencia en beneficio de cualquier descendiente, sin que se le exija para ello ninguna discapacidad al beneficiado, entiendo interesante cuestionar si, tal vez, con la redacción actual del 808, el tener un descendiente legitimario con discapacidad no podrá encuadrarse en uno de los casos expresamente determinados en la ley que facultan al testador, según el 813, a dejar al resto de herederos sin herencia.

 

Abstract

After the reform introduced in the Civil Code by Law 8/2021, article 808, in the first sentence of its new fourth paragraph, literally allows the testator who has legitimate descendants with disabilities "to dispose in their favor of the strict legitimate of the others legitimaries without disabilities.

The aforementioned fourth paragraph continues with a second sentence stating that "In such case, unless otherwise provided by the testator, what is thus received by the beneficiary child will be encumbered with trustee substitution of residue...".

Therefore, unlike the previous wording of 808, whose third paragraph was made up of a single sentence that allowed trustee substitution as the only possible tax on the legitimate strict, currently, the same paragraph, now fourth, is divided in two different sentences in which it allows the testator, first, to dispose of the strict legitima without setting any specific limit in this regard, to, secondly, speak of the trustee substitution of residue on a subsidiary basis, since this will come into play except contrary disposition of the testator.

The reformist spirit of the 2021 legislator regarding the intangibility of the strict legitimate is appreciated not only with the fact that he has opted for the trustee substitution of waste as a type of subsidiary tax that can fall on the strict legitimate, modality of the institution that empowers the trustee with disabilities to dispose of the assets that make up the strict legitima, but also with the fact of exponentially expanding its possible beneficiaries, since until the reform only those who were legally incapacitated could do so (today it could be people with disabilities with a curator representative), and currently it is people with disabilities who can be favored by the testator with the strict legitimate third.

Even though it is true that article 813 of the C.c. establishes that the testator may not deprive the heirs of his legitimacy except in cases expressly determined by law, it is also true that today the C.c. expressly determines in its article 808 that when the testator has a legitimary descendant with a disability, he may, for his benefit, deprive the rest of legitimaries without disabilities of his strict legitimacy.

Should we then consider having a legitimate descendant with a disability as one of the cases expressly determined by law to leave the rest of the heirs without legitimate?

I find it interesting to raise such a possibility, especially considering that there are more than four million Spaniards who can freely deprive their heirs of their legitimacy, since in Aragon, the Basque Country and Navarra, testators may leave their entire inheritance to any of their descendants, whether or not they have a disability.
