Resumen
El sonido del piano (evitable e insoportable) produce una vulneración del derecho a la intimidad familiar y personal de los vecinos cuyo ejercicio precisa, dentro del domicilio un ámbito inmune frente a las agresiones perturbadoras, procedentes del exterior, que no exijan el deber específico de soportarlas. Los ruidos desaforados y persistentes, aunque procedan del desarrollo de actividades lícitas, dejan de serlo cuando se traspasan determinados límites, como es el caso del piano y como tales se consideran agresiones.
Abstract
The avoidable, unbearable sound of a piano violates a neighbour's right to family and personal privacy. Exercise of that right requires that the atmosphere within the home be immune to disturbing aggressions from outside. The resident has no specific duty to bear such aggressions. Pounding, persistent noise may be produced by lawful activities but ceases to be lawful in itself when certain limits are trespassed (as in the case of the piano), at which point the noise is considered an aggression.
